The Tesla FSD India question got sharper this week, and from an unlikely direction. On October 30, Tesla India pushed a Halloween Mode to every Model Y and Model Y L over the air. Spooky sounds, ghost avatars and flickering lights arrived overnight, with no service visit needed.
Three days earlier, police in Seoul said they had booked 80 Tesla owners for forcing open the one feature Tesla has not switched on for them: Full Self-Driving.
Together, the two stories carry a lesson for Tesla buyers in India. Your car is partly a software product, and what it can do depends on Tesla, the regulator and you.
What did Tesla’s Halloween Mode update add in India?
Tesla’s October 30 update gave the Model Y and Model Y L in India a ghost-themed app avatar, Halloween sounds, a special light show, seasonal wraps and a themed lock sound. It also added Trick or Treat Mode, a photobooth, and Voice From Beyond, which plays messages sent from the app through the car.
Tesla used the update to stress that its cars get new features remotely. Buyers can see it at experience centres in Noida, Delhi, Gurugram, Chennai, Hyderabad, Bengaluru and Mumbai.
It is light, seasonal fun. It also shows that Tesla can change how an Indian Model Y behaves at any time, from far away.
Why did South Korea book 80 Tesla owners?
Seoul police booked 80 people for using unauthorised devices to switch on FSD in Teslas that are not approved for it. They also seized 21 devices. Officers say the devices were bought in Europe or China, or built at home, and that the case breaks Korea’s Motor Vehicle Management Act.
The penalty can be up to two years in prison or a fine of up to 20 million won, about $15,000. Some suspects swapped tips online on hiding the activation from the car’s records.
The root cause is where the car was built. In Korea, FSD is legal only on US-built Model S, Model X and Cybertruck, which are covered by a Korea-US trade deal exemption. China-built Model 3 and Model Y have not passed Korea’s safety rules for FSD.
That leaves most Korean owners locked out. Car market research firm Carisyou Data Lab says just 47,458 of 229,311 Teslas on Korean roads, or 20.7 percent, could legally use FSD as of August.
Why can an OTA update bring Halloween Mode but not FSD?
Halloween Mode is entertainment. It changes lights, sounds and graphics, so Tesla can switch it on whenever it likes. FSD steers, brakes and changes lanes on public roads. That makes it a safety system, and each country decides whether it is allowed. Without that approval, the switch stays off.
| Feature type | Example | Who decides | Status in India |
|---|---|---|---|
| Fun and seasonal | Halloween Mode, light show, lock sounds | Tesla alone | Live since October 30 |
| Basic driver assistance | Autopilot features such as lane departure avoidance | Tesla, within existing rules | Offered |
| Advanced automation | FSD (Supervised) | Government approval needed | Locked |
| Pricing of FSD | One-time purchase or subscription | Tesla | Subscription “coming soon”, no price |
According to Dong-A Ilbo, the transport ministry’s main objection is a rule that assumes a driver uses the turn signal before an assisted lane change. FSD decides on its own. Tesla Korea has applied for approval, the paper says.
India’s Model Y, like the cars blocked in Korea, is imported from Tesla’s Shanghai factory. In India, though, the block has nothing to do with the factory. Here, FSD simply has not been cleared at all.
Where does FSD stand in India today?
FSD cannot be used in India. Tesla sold it as a ₹6 lakh option when the Model Y launched in July 2025, while saying it was pending government clearance. In July 2026, Tesla removed the one-time purchase from its India website and now says a subscription is coming soon, without a price or date.
| Item | India | South Korea |
|---|---|---|
| Where Model Y is built | Shanghai, China (imported) | Shanghai, China (imported) |
| FSD on Model Y | Not usable, no approval yet | Not allowed on China-built cars |
| FSD on any Tesla | Not usable | US-built Model S, Model X, Cybertruck only |
| Enforcement on unlock devices | None reported | 80 owners booked, 21 devices seized |
| How to buy FSD | Subscription “coming soon” | Sold, but restricted by vehicle origin |
ACKO Drive reported that the ₹6 lakh was non-refundable, with no promised activation date.
Tesla’s own branding is shifting too. In Europe it has renamed the feature, as we covered in our report on Tesla Assisted Driving. The system still needs a driver who is watching the road.
What happens if you unlock FSD with a device?
You risk losing far more than you gain. Tesla can detect plug-in unlock devices remotely. Electrek reported in April that owners in China, Europe, Korea and Turkey said Tesla had stripped FSD from such cars. It told owners they are fully liable for any crash and that it may refuse warranty repairs.
These devices cost around €500, according to Electrek, and plug into the car’s internal network. Korean police warn that hacked FSD may misread road conditions or act against the driver’s intention.
We found no reports of Indian owners using such devices, and no Indian enforcement action. That does not make it safe. India has not approved FSD, and running unapproved driving software on Indian roads is exactly what Korea is now prosecuting.
Reuters reported this week that a Japanese lawmaker had flagged security concerns about Chinese cars that can be controlled from outside. That remote power is what delivered Halloween Mode, and it cuts both ways.

What should Indian Model Y owners do about FSD?
Wait for the official subscription and leave the car’s software alone. Buy only from Tesla and only when it is approved. Do not plug unknown devices into the car. Keep accepting OTA updates, which carry fixes as well as fun features like Halloween Mode.
If you are still deciding whether to buy, judge the Model Y on what works today: range, space, charging and service reach. Our breakdown of the Tesla Model Y EMI offer shows what the monthly cost really looks like.
CarBike Insight Analysis
Halloween Mode is harmless fun, but it is also a demonstration that an Indian Tesla keeps changing after delivery.
The Korea case shows the other side of the same coin. Software control means the carmaker and the regulator, not the owner, decide what the car may do. Software-led cars are becoming the norm, as an industry survey on automotive software also suggests, so that balance of power will matter more for every brand, not just Tesla.
For India, FSD is not a feature you can count on yet.
Who should wait? Buyers whose main reason for choosing a Tesla is FSD. There is no approval, price or date. Who should not wait? Buyers who want a well-made electric SUV with strong software support today. For them, FSD is a bonus that may or may not arrive.
